DMCA & Copyright Policy

1. Introduction

Best IPTV Canada respects the intellectual property rights of others and expects the same from anyone using our service. This policy explains how copyright holders can report content they believe infringes their rights, and how we respond to such reports.

As a Canadian business, we operate primarily under Canada’s Copyright Act, which uses a “notice-and-notice” framework rather than the U.S. notice-and-takedown system. Where our service or hosting involves U.S.-based infrastructure, we also aim to comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, as applicable.

2. Our Role as a Service Provider

Best IPTV Canada acts as a subscription and technical service provider. We do not create, produce, or claim ownership of third-party broadcast content accessed through our service. We are an intermediary, not a content publisher.

In accordance with applicable law, we may limit, disable, or investigate access related to content that is credibly reported as infringing.

3. Filing a Copyright Notice

To be considered valid, a copyright notice should include:

A physical or electronic signature of the copyright holder or their authorized representative
A clear description of the copyrighted work you believe has been infringed
Specific identification of the content in question (as much detail as possible — the channel, program, or material involved, and when the issue was observed)
Your full contact information (name, email address, and mailing address if available)
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Incomplete notices may not be actionable and may delay our response.

4. How to Submit a Notice

Incomplete notices may not be processed.

5. Our Process

When we receive a valid notice, we will generally:

Acknowledge receipt within a reasonable timeframe
Review the notice for completeness and validity
Take appropriate action if the notice is valid, which may include restricting access to the content in question
Notify the relevant party where appropriate

We reserve the right to act without advance notice where circumstances require it.

6. Counter-Notice

If you believe content was restricted in error or as a result of misidentification, you may submit a counter-notice including:

Your signature
Identification of the content that was restricted and its previous location
A statement, under penalty of perjury, that you have a good-faith belief the content was restricted as a result of mistake or misidentification
Your full contact information
A statement consenting to the jurisdiction of the appropriate court

7. Repeat Infringer Policy

We apply a graduated response to repeat copyright issues:

First instance: written warning
Second instance: temporary suspension of access
Third instance: permanent termination of the subscription, without refund

Accounts created to circumvent a suspension will also be terminated.

8. False Claims

Submitting a knowingly false copyright notice may expose the person making the claim to legal liability. Please make sure you are the rights holder, or authorized to act on their behalf, before submitting a notice.

9. Fair Dealing

Before submitting a notice, consider whether the use in question may fall under fair dealing (Canada) or fair use (U.S.) — for example, for purposes of research, private study, criticism, review, news reporting, or education. Not every use of copyrighted material is an infringement.

10. Limitation of Liability

Best IPTV Canada is not responsible for:

Content originating from third-party or external sources
The individual actions of users
Temporary restriction of content in response to a notice
Indirect damages arising from a copyright dispute or notice process
